ANC TERMS OF USE AND LOYALTY PROGRAM TERMS

These Terms of Use (“Terms”) govern your access to and use of ANC websites, mobile applications, related content, and the ANC Loyalty Program (“Program”). By accessing or using any part of the Service or by enrolling in the Program, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service or enroll in the Program. The Program is operated with the support of Alpine IQ.

Definitions

  • Service means the ANC websites, the ANC Loyalty Program, and any related applications or content.
  • Websites means: https://ancdispensary.com and https://ancdispensary.co.
  • Program means the ANC Loyalty Program and its app-based features.
  • We, us, and our mean ANC Dispensary and its affiliates.
  • You means the individual visiting the Websites and or enrolling in or using the Program.

Eligibility

  • Recreational customers must be 21 or older.
  • Medical marijuana patients must be 18 or older in compliance with Arizona law.
  • The Service is for personal, non-commercial use only.
  • You may not use the Service if previously banned.

Changes and Duration
We may update these Terms at any time. Updates take effect on the “Last Updated” date listed above. Each time you access the Service or remain enrolled in the Program, you agree to the current Terms.

Limited License
Subject to these Terms, ANC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful, personal purposes. All rights not expressly granted are reserved.

Privacy
We collect and use information as described in our Privacy Policy. By participating in the Program, you consent to ANC and Alpine IQ retaining your contact details, engagement history, and purchase history for personalized marketing.

Sensitive Information and Identity Verification
ANC may facilitate identity verification through a secure, phone number verified portal operated by a third-party provider. If identity verification is required, you will be directed to that secure portal to upload images of your government-issued identification and to complete any required biometric checks. Do not send sensitive personal information through email, standard text message, chat, or other unsecure channels. ANC is not responsible for sensitive information submitted through unsupported channels. Use only the secure portal or other methods that we expressly designate for identity verification.

Account Security
You are responsible for maintaining the confidentiality of your Program account credentials and for all activity that occurs under your account. You agree to notify ANC immediately of any unauthorized use of your account. ANC is not responsible for losses caused by unauthorized account access if you fail to follow this obligation.

Restrictions on Use
You agree not to misuse the Service, including attempting to gain unauthorized access, interfering with operation of the Service, using automated systems to collect data, or reselling Program benefits. ANC reserves the right to suspend or terminate accounts engaged in misuse.

Medical Disclaimer
Information provided by ANC, whether on the Website, in the App, or through communications, is for informational purposes only and is not intended as medical advice. Always seek the advice of a licensed healthcare provider for medical questions. Do not disregard professional medical advice because of something you read through ANC.

Communications Preferences and Opt-Out
You may manage or opt out of communications at any time. Continued participation in the Program requires that you remain subscribed to at least one communication channel (push notifications, text messages, or emails). If you opt out of all communication channels, you will not be able to redeem discounts, loyalty points, or other Program benefits.

How to manage preferences:

  • In-app for iOS: Profile > Communication Settings > toggle Push, Email, or Text.
  • In-app for Android: Profile > Communication Settings > toggle Push, Email, or Text.
  • Device settings for iOS: Settings > Notifications > [App Name] > toggle off.
  • Device settings for Android: Settings > Apps > [App Name] > Notifications > toggle off.
  • Text opt-out: reply “STOP” to any text from us.
  • Email opt-out: use the unsubscribe link in promotional emails.

By providing your phone number, you consent to receive informational and marketing calls and texts from or on behalf of ANC, which may include autodialed or prerecorded messages. Standard message and data rates may apply. Consent is not required to make a purchase. By providing your email, you consent to receive promotional emails.

Responsibility for Phone Numbers and Consent
You represent that you are the current subscriber or customary user of any phone number you provide. If your phone number changes, you agree to promptly update your account and, if possible, send STOP from the old number. You will not provide a number that you do not own or control.

Electronic Communications and Signatures
By using the Service or enrolling in the Program, you consent to receive electronic communications from ANC. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing. You also agree to the use of electronic signatures and records for Program enrollment and transactions.

Monitoring and Recording Notice
Customer support calls, chats, texts, and emails with ANC may be monitored or recorded for quality, training, and compliance. By communicating with ANC, you consent to such monitoring or recording to the extent permitted by law.

ANC Loyalty Program

Enrollment

  • The Program is free to join.
  • Enrollment is available online, in-store, in-app, or via supported messaging.
  • Only one Program account per person and phone number.
  • Provide accurate information and keep it updated.

Earning Points

  • Points accrue on marijuana purchases only. Accessories, non-marijuana items, delivery fees, credits, and taxes do not earn points.
  • Points accrue on the actual dollar amount paid for marijuana, including discounted amounts.
  • Points are calculated to one decimal place and rounded down to the nearest tenth. Example: 5 dollars at 1.2 points per dollar equals 6 points.

Tier Structure (resets every August 26)

  • Base Tier: No spend requirement. 1 point per 1 dollar.
  • Premium Tier: 1,000 dollars annual spend. 1.2 points per 1 dollar.
  • Top Tier: 2,000 dollars annual spend. 1.3 points per 1 dollar.
  • Diamond Tier: 4,200 dollars annual spend. 2 points per 1 dollar.

Tier upgrades occur within approximately 24 hours after qualifying spend is verified. Downgrades occur only at the annual reset. Tier status is retained even if points expire, provided the spend requirement was met before reset.

Expiration
Points expire 180 days after the last qualifying purchase. Any new qualifying purchase resets the expiration clock.

Points Not Property and Ledger Corrections
Points have no cash value, are not your property, and cannot be sold, assigned, or transferred. ANC may correct or revoke any points or rewards that were credited or issued in error, obtained by fraud or misuse, or otherwise not earned in accordance with these Terms. The in-app or receipt ledger is provided for convenience and may be adjusted to reflect corrections.

Redeeming Points
Rewards must be redeemed at checkout and are subject to availability and state purchase limits. ID presented must match the Program account name.

Standard Redemption Options

  • 200 points equals 5 dollars off purchase total
  • 500 points equals 25 dollars off purchase total
  • 600 points equals 25 percent off purchase total
  • 750 points equals BOGO marijuana product, equal or lesser value, up to 7 grams flower or other marijuana product. Accessories are excluded. Not stackable with other offers.
  • 900 points equals free half ounce of select flower designated by ANC, subject to availability
  • 1000 points equals 60 dollars off purchase total

Rewards are not stackable with other offers or discounts in the same transaction. Redemption frequency limits may apply as displayed in the App.

Limited-Time Offers
In addition to the standard redemption options, ANC may from time to time make available limited-time or promotional discounts, offers, or deals through the App. These promotions may vary in scope, value, eligibility, and duration, and may be subject to additional terms presented at the time of the offer. Such offers are not guaranteed to be available at all times and may be modified or withdrawn by ANC in its sole discretion without prior notice.

Disqualifying Activities
ANC may suspend or terminate accounts and cancel points if customers engage in fraud, illegal activity, misrepresentation, multiple accounts, or attempts to sell or transfer points.

Program Changes
ANC may modify, suspend, or discontinue the Program, including redemption values, tiers, accrual, and expiration policies, at any time, with or without notice.

Force Majeure
ANC will not be liable for any delay or failure to perform due to causes beyond its reasonable control. These causes include internet or carrier outages, power failures, labor disputes, acts of God, governmental actions, or other events of force majeure.

Intellectual Property
All content on the Service is owned by ANC or its licensors. You may not copy, distribute, or create derivative works without prior written permission. ANC respects intellectual property rights. Any concerns should be directed to info@ancdispensary.com.

Governing Law
These Terms and any disputes shall be governed by Arizona law. If arbitration is found unenforceable, all claims must be brought exclusively in the state or federal courts located in Maricopa County, Arizona.

Arbitration and Class Action Waiver

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR RIGHTS. YOU AGREE THAT BY USING THE WEBSITE OR THE SERVICE, ENROLLING IN OR USING THE PROGRAM, OR OTHERWISE AGREEING TO THESE TERMS, YOU AND ANC ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. YOU AND ANC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITIES, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.

You and ANC agree that any and all claims and disputes arising from or relating in any way to these Terms, your use of the Website, Service, or Program, or your and our dealings with one another shall be finally settled and resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, or if unavailable, JAMS under its Consumer Minimum Standards. The arbitration will be conducted by a single arbitrator with substantial experience in commercial contract disputes. For claims under 10,000 dollars, the arbitration may be conducted solely by telephone, video conference, and or written submissions, at the option of the party initiating the claim. For claims exceeding 10,000 dollars, a hearing will take place in Maricopa County, Arizona, unless you and ANC otherwise agree in writing. The arbitrator’s decision shall be final and binding and may be entered in any court of competent jurisdiction.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. Neither you nor ANC will be able to bring or participate in a class action, class arbitration, or any other representative action.

Opt-Out of Arbitration
If you do not wish to be bound by this arbitration provision, you may opt out within thirty days of the date you first become subject to these Terms, which is the earlier of the date you enroll in or first use the Program. To opt out, you must send a written notice of your decision by certified mail with return receipt requested to:

Your opt-out notice must include your full name, mailing address, the phone number associated with your Program account, and a clear statement that you wish to opt out of the arbitration provision of these Terms. This is the only method by which you can opt out. If you do not send such notice within thirty days, you will be bound by the arbitration provision.

Statute of Limitations
Any cause of action or claim you may have arising out of or relating in any way to these Terms, your use of the Website, Service, or Program, or your and our dealings with one another must be commenced within one year after the cause of action accrues. After that one-year period, such cause of action or claim is permanently barred.

Limitation of Liability
To the fullest extent permitted by law, ANC’s total liability for any claims arising from or related to these Terms or the Program will not exceed one hundred dollars.

General
No waiver. A failure to enforce any term is not a waiver of that term.
Severability. If any term is held invalid or unenforceable, the remaining terms remain in effect.
Assignment. You may not assign your rights or obligations under these Terms. ANC may assign these Terms in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms are the entire agreement between you and ANC regarding the Service and the Program.
